RE: The tariff classification of pigments from China.

Dear Mr. Sutherland:

In your letter dated December 22, 1998, you requested a tariff classification ruling.

The applicable subheading for Pigment Red 122 (Red 9) will be 3204.17.6085, Harmonized Tariff Schedule of the United States,(HTS), which provides Synthetic organic coloring matter, whether or not chemically defined; preparations as specified in note 3 to this chapter based on synthetic organic coloring matter; synthetic organic products of a kind used as fluorescent brightening agents or as luminophores, whether or not chemically defined: Synthetic organic coloring matter and preparations based thereon as specified in note 3 to this chapter: Other: Other. The rate of duty will be 10.8 percent ad valorem.

The applicable subheading for Pigment Red 48:2 (Red 4) and Pigment Red 57:1 (Red 4BP) will be 3204.17.9085, HTS, which provides Synthetic organic coloring matter, whether or not chemically defined; preparations as specified in note 3 to this chapter based on synthetic organic coloring matter; synthetic organic products of a kind used as fluorescent brightening agents or as luminophores, whether or not chemically defined: Synthetic organic coloring matter and preparations based thereon as specified in note 3 to this chapter: Other: Other. The rate of duty will be 13.2 percent ad valorem.

The applicable subheading for Pigment Red 101 (Red 12) and Pigment Red 101 (Red 13) will be 2821.10.0020, HTS, which provides for Iron oxides and hydroxides; earth colors containing 70 percent or more by weight of combined iron evaluated as Fe2 O3: Iron oxides and hydroxides: Synthetic pigments: Red. The rate of duty will be 3.7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
